Exemption under Notification No. 97/2009 – Customs extended upto 30/09/2011

Note: Consequence of the Notification is that, exemption given under Notification No. 97/2009 (principal Notification) is extended upto 30th day of September, 2011. Meaning of  Let Export Order is also inserted in the Principal Notification.

Notification No. 51/2011 – Customs

G.S.R  (E). –  In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following amendment in the notification of the  Government of India in the Ministry of Finance (Department of Revenue), No. 97/2009-Customs, dated the 11th September, 2009, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i),  vide number G.S.R. 663(E), dated the 11th September, 2009, namely :-

In the said notification, –

(i)      for para 2,  the following para shall be substituted, namely:-

2. This notification shall be valid in respect of the Duty Entitlement Pass Book Scrips issued by the Licensing Authority  against exports having Let Export Order up to and inclusive of the 30th day of September, 2011.

(ii)    after Explanation (iv), the following Explanation shall be inserted, namely:-

(v) Let Export Order means an order which permits clearance and loading of the goods for exportation by the proper officer in accordance with section 51 of the said Customs Act.

Note.-  The principal notification No.97/2009-Customs, dated the 11th September, 2009 was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 663(E), dated the 11th September, 2009 and was last amended by notification No. 40/2011-Customs, dated the 19th May, 2011, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i),vide number G.S.R. 390 (E), dated the 19th May, 2011.
