Ministry of Corporate affairs (MCA) has notified Companies (Adjudication of Penalties) Amendment Rules, 2019 dated 19th February, 2019, wherein the Central Government may appoint any of its officers not below the rank of Registrar, as adjudicating officers for adjudging penalty. The adjudicating officer for the purpose of adjudicating penalty, shall issue a written notice indicating (non-compliance, default, relevant penal provision, maximum penalty) to the relevant person to show cause why the penalty should not be imposed. Further, reply to this notice shall be filed only in the electronic mode.
