In exercise of the powers conferred by clause (41) of section 2, section 3, sub-section (1) of section 7, section 10A, section 14 and sub-sections (1.) and (2) of section 469 of the companies Act,2013 (18 of 2013), the Central Government hereby notifies Companies (Incorporation) Fourth Amendment Rules, 2018 vide notification 18th December, 2018 to amend the Companies (Incorporation) Rules, 2014.
The notification provides for new Rule providing for-
a.) Declaration to be filed at the time of Commencement of Business in Form INC-20A along with format of the Form;
b.) Amended provisions for filing of application u/s 2(41) for change in Financial Year with Regional Director;
c.) Amended provisions for filing of application u/s 14 for conversion of public company into private company;
alongwith new formats of Form INC-20A (Declaration for commencement of business), Form INC- 25A (Advertisement to be published in the newspaper for conversion of public company into a private company), Form RD-1 (Form for filing application to Regional Director) and Form RD GNL-5 (Form for filing Addendum for rectification of detects or incompleteness)
