The Transplantation of Human Organs Act, 1994 is in force all over the country except the states of Jammu & Kashmir and Andhra Pradesh(who have their own Acts pertaining to organ donation). The Transplantation of Human Organs (Amendment) Act 2011, after receiving the assent of the President of India was published in the Gazette of India on 28.9.2011.
Based on the Transplantation of Human Organs (Amendment) Act, 2011, the draft Transplantation of Human Organs and Tissue Rules 2013 were placed in the public domain for inviting comments by publishing a public notice to enable the public at large to file their objections and make suggestions, if any.
After taking into consideration the aforesaid suggestions/ objections, the Rules will be notified. Till then the existing Transplantation of Human Organs Act 1994 and Rules made there under are applicable.
