The Hon’ble High Court of Delhi, in its recent judgment dated 5th April, 2016, has passed a stay order against the Circular/Notification no. CG Office/TMR/Public Notice/2016, dated 4th April, 2016, issued by the Office of the Controller General Patents, Designs and Trademarks. Vide abovementioned circular/notification, the applications against which no reply to examination report containing office objections to acceptance of the applications for registration has been received within the period of 30 days of physical service of examionation report would be abandoned, as per Trade Marks Act, 1999 and rules made thereunder. However, the following judgment has rendered the abovementioned circular/notification temporarily ineffective,-
